Open Letter to All Visitors

Dear Visitor:

From Article 2, Section 2 of the Constitution: "He (the president) shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments."

As can be seen the President has the sole right and power to nominate/appoint judges. The Senate has the responsibility to advise and give consent. Some issues that would make sense for the Senate to consider are: qualifications (i.e. education, understanding, ability), dedication to the Constitution, moral character (being defined as if they are a good citizen, free of any major flaws and criminal history), etc. It should not include any issues related to religion, political affiliation, etc.

From Article 6 of the United States Constitution: "This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States."

We have to major issues that become apparent under the preceding paragraphs:

  1. The United States Supreme Court has not been upholding the Constitution.
    • Firstly, more and more of their rulings are not based on our Constitution nor our Treaties, which has been defined as the law of this land!
    • Secondly, they often make law instead of ruling upon it. They have no power to make law, regardless of what powers they have given themselves.
  2. The extreme liberals in congress do not uphold the Constitution for similar reasons. They also violate the Constitution because they impede Presidential Appointments of individuals on grounds outside of what might be considered reasonable and legal (under the Constitution).

I beg you to read my July 4th letter. In it you will find a copy of the Declaration of Independence. I hope you will find, as I have, that we are indeed in a crisis in America. The very things our forefathers fought and died for are being eroded again. I am NOT calling people to overthrow our government. Our government still works!! We can fix this by writing our elected officials, by electing different officials, etc.

So, what brought us to these sad state of affairs. That is fairly easy.

  • Firstly, a large group of US Citizens are apathetic to the law and to the democratic process.
  • Secondly, by and large the US Citizenry is completely ignorant of their history and heritage; namely the true history of our country. They are also almost completely ignorant of what the Constitution, Bill of Rights, etc. actually say.
  • Thirdly, "Those willing to give up a little liberty for a little security deserve neither security nor liberty." -- Benjamin Franklin. Too many of us want security that will never come. In the process we give up more and more freedom.
  • Fourthly, "Liberty means responsibility. That is why most men dread it." -- George Bernard Shaw, Liberty. (Self explanatory and goes with number one above.)

Please, support any judge appointed by any President who has the appropriate abilities, moral character and, most importantly, will uphold the Constitution of the United States. Some call such judges originalists. It is time we have far more of them on the court.
